Information on data transfer to the USA and other non-EU countries

Among other things, we use tools of companies domiciled in the United States or other from a data protection perspective non-secure non-EU countries. If these tools are active, your personal data may potentially be transferred to these non-EU countries and may be processed there. We must point out that in these countries, a data protection level that is comparable to that in the EU cannot be guaranteed. For instance, U.S. enterprises are under a mandate to release personal data to the security agencies and you as the data subject do not have any litigation options to defend yourself in court. Hence, it cannot be ruled out that U.S. agencies (e.g., the Secret Service) may process, analyze, and permanently archive your personal data for surveillance purposes. We have no control over these processing activities.

Right to data portability

You have the right to demand that we hand over any data we automatically process on the basis of your consent or in order to fulfil a contract be handed over to you or a third party in a commonly used, machine readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.

Rejection of unsolicited e-mails

We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in our Site Notice to send us promotional and information material that we have not expressly requested. The operators of this website and its pages reserve the express right to take legal action in the event of the unsolicited sending of promotional information, for instance via SPAM messages.

We will not share this information without your consent.

The processing of these data is based on Art. 6(1)(b) GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6(1)(f) GDPR) or on your agreement (Art. 6(1)(a) GDPR) if this has been requested.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data or if the purpose for which the information is being archived no longer exists (e.g., after we have concluded our response to your inquiry). This shall be without prejudice to any mandatory legal provisions, in particular retention periods.

Registration on this website

You have the option to register on this website to be able to use additional website functions. Google Analytics

Google Analytics enables the website operator to analyze the behavior patterns of website visitors. This analysis tool is used on the basis of Art. 6(1)(f) GDPR. The operator of this website has a legitimate interest in the analysis of user patterns to optimize both, the services offered online and the operator’s advertising activities. IP anonymization

On this website, we have activated the IP anonymization function. As a result, your IP address will be abbreviated by Google within the member states of the European Union or in other states that have ratified the Convention on the European Economic Area prior to its transmission to the United States. Contract data processing

We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

Demographic parameters provided by Google Analytics

This website uses the “demographic characteristics” function of Google Analytics, to be able to display to the website visitor compatible ads within the Google advertising network. This allows reports to be created that contain information about the age, gender, and interests of the website visitors. The sources of this information are interest-related advertising by Google as well as visitor data obtained from third-party providers. This data cannot be allocated to a specific individual. You have the option to deactivate this function at any time by making pertinent settings changes for advertising in your Google account or you can generally prohibit the recording of your data by Google Analytics as explained in section “Objection to the recording of data”.

Archiving period

5. Plug-ins and Tools

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter referred to as “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to determine whether data entered on this website (e.g., information entered into a contact form) is being provided by a human user or by an automated program. To determine this, reCAPTCHA analyzes the behavior of the website visitors based on a variety of parameters. This analysis is triggered automatically as soon as the website visitor enters the site. For this analysis, reCAPTCHA evaluates a variety of data (e.g., IP address, time the website visitor spent on the site or cursor movements initiated by the user). The data tracked during such analyses are forwarded to Google.

reCAPTCHA analyses run entirely in the background. Website visitors are not alerted that an analysis is underway.

Data are stored and analyzed on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the protection of the operator’s websites against abusive automated spying and against SPAM. 6. eCommerce and payment service providers

Processing of data (customer and contract data)

We collect, process, and use personal data only to the extent necessary for the establishment, content organization or change of the legal relationship (data inventory). These actions are taken on the basis of Art. 6(1)(b) GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual actions. We collect, process, and use personal data concerning the use of this website (usage data) only to the extent that this is necessary to make it possible for users to utilize the services and to bill for them.

The collected customer data shall be eradicated upon completion of the order or the termination of the business relationship. This shall be without prejudice to any statutory retention mandates.

7. Custom Services

Job Applications

We offer website visitors the opportunity to submit job applications to us (e.g., via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g., contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 New GDPR according to German Law (Negotiation of an Employment Relationship), Art. 6(1)(b) GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6(1)(a) GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 New GDPR and Art. 6(1)(b) GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we are unable to make you a job offer or you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards the data will be deleted, and the physical application documents will be destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the expiry of the 6-month period (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your agreement (Article 6(1)(a) GDPR) or if statutory data retention requirements preclude the deletion.

What is the purpose and scope of processing of your personal data?

We store the personal data provided by you to establish and/or maintain our business relationship, in particular, relating to the performance of a contract or the implementation of pre-contractual measures.

For how long will we store your data?

Where no specific retention period has been specified upon collection of your personal data, we will erase your data as soon as they are no longer required for the aforementioned purposes. However, your data will be retained for as long as we need the data for the defence of legal claims brought against us.

Where data has been processed for accounting purposes, the necessary personal data will be erased in accordance with statutory retention periods.

The provision of your personal data is voluntary. For what purpose and to what extent do we process your personal data?

We process your personal data in connection with your application insofar as this is necessary for the decision regarding the establishment of an employment relationship. In addition, we also process this personal data in the event of an employment relationship being established for the purpose of carrying out the employment relationship. What data we process from you depends on which data you make available to us.

The following data categories can be included:

  • Contact details (name, date of birth, address, telephone number, e-mail)
  • Application documents (cover letter, C.V., previous professional experience, training and certificates, notes from job interviews)
  • Desired salary
  • Type of desired employment
  • The starting date
  • All correspondence you have with us during the application process
  • Data subject to professional secrecy, if any (health suitability, any restrictions)
  • Particularly sensitive data (e.g. health data)
  • Other data (ownership of drivers licence)

The legal basis on which the data is processed:

Section 26 (1) sentence 1 BDSG (new) in connection with (8) sentence 2 BDSG (new) entitles us to store the personal data of applicants if this is necessary for the decision on the establishment of an employment relationship. If the processing of your health data should be necessary, Section 22 (1b) BSDG (new) is the legal basis.

In some cases, your consent is required for the processing. This may be the case if we want to include you in an applicant pool in order to consider you for future vacancies. The legal basis for this is Art. 6 para. 1a) GDPR in connection with Art. 7 GDPR.

We may also process your personal data to the extent necessary to defend legal claims arising from the application process (e.g. AGG allegations). The legal basis is Art. 6 para. 1c) GDPR.

If a dispute arises between you and Franz Miederhoff GmbH & Co. KG, we can process the data you have already provided us with. The legal basis is Art. 6 para. 1b) GDPR.

Who gets your data?

Within the company, only those persons and positions who are involved in the processing of your application receive the personal data in connection with your application. A transfer to third parties will only take place if we are legally obliged to do so, or if you have expressly consented to the transfer.

What rights can you assert as a data subject?

You can request information about the data stored about you. In addition, under certain circumstances, you may request the correction or deletion of your data. You may also have a right to limit the processing of your data and a right to have the data you have provided disclosed in a structured, common, and machine-readable format. The more precisely you tell us your wishes or define the scope of the information, the more precisely we can process and respond to your request.

Right of objection

If we process your data to safeguard legitimate interests, you may object to this processing for reasons arising from your particular situation. We will then no longer process your personal data unless we can prove compelling reasons for processing worthy of protection which outweigh your interests, rights and freedoms, or if the processing serves the assertion, exercise or defence of legal claims.

If, for example, you have given us your consent to process your personal data within the scope of inclusion in the applicant pool, you have the possibility to revoke this at any time. However, this has no influence on the processing already carried out.

Where can you lodge a complaint?

How long is your data stored?

We will delete your data as soon as it is no longer required for the above-mentioned purposes. However, your data will be stored as long as it is necessary to defend against asserted legal claims (e.g. AGG accusations).

As a general rule, the retention period for application data is 6 months, unless your application was provided to us by a personnel service provider and, in this way, is subject to longer-term commission claims by the personnel service provider, or if you have given us your permission to consider your data for future vacancies.

If processing relevant to accounting has been carried out (e.g. reimbursement of travel expenses), the necessary personal data will be deleted in accordance with the statutory retention periods.

If an employment relationship arises between you and Franz Miederhoff GmbH & Co. KG, we will process your data in accordance with the privacy statement for employees, which we will send to you at the beginning of your employment.

Are you obliged to provide your data?

The provision of your personal data is voluntary. However, the provision of this data is necessary for the processing of your application or the conclusion of an employment contract with Franz Miederhoff GmbH & Co. KG Without this data, we cannot enter into an employment relationship with you.
